Who is responsible for repairs to a marquee donated to a district by ASB?

Question: Our middle school ASB purchased a marquee several years ago and donated it to the district. It needs some repair now. Can ASB pay for those repairs if they want to, or is it the district's responsibility?

Response: The answer to your question is really up to the discussion/agreement that was in place when the district accepted the marquee as a donation.  Normally items such as this are donated to the district because the marquee is placed on district property, but the usual agreement that we've seen is that if the item needs repairs or updating, the ASB will pay for the improvements/repairs since the original purchase was from ASB funds.

As you know, ASB funds should not be used to purchase items that are the district's responsibility or to maintain district equipment.  But items donated to the district are really a different category and an exception. Hopefully when the marquee was donated to the district this was done at an official meeting and recorded in ASB meeting minutes, so that would be the place to find what agreement is in place, if any, on the repair and maintenance of the marquee.
