CDE Amends its Notice of Parents Rights for Special Ed Students

The California Department of Education (CDE) recently amended its Special Education Rights of Parents and Children (Parents Rights) to reflect changes made in California statutory law which are effective January 1, 2004.

The first statutory change relates to the right of an independent educational assessor to conduct an observation of a child in his or her classroom. (Ed. Code Section 56329(b) and (c).) The second statute change relates to a school district's right to observe a child in his or her placement when the child has been unilaterally placed in a nonpublic school and the parent is requesting that the distrct fund such a placement. (Ed. Code Section 56329(d).)

Following is the CDE website where you may obtain a copy of the most recent Parent's Rights.

What this means to you: We recommend that you review the Parent Rights developed by CDE and/or ensure that the notice of parent rights your school district uses is consistent with the Parents Rights developed by CDE.
