Can teachers be reimbursed from ASB funds for expenditures not pre-approved?

Question: In the district office, I frequently get requests to reimburse teachers from ASB funds for such things as field trip admissions, which I could have paid directly. Rather than submitting a request for pre-approval, teachers often use their own personal funds, then request reimbursement after the fact. What is your opinion of this practice?

Response:  Education Code section 48933 is very clear in stating:

"The funds shall be expended subject to such procedure as may be established by the student body organization subject to the approval of each of the following three persons, which shall be obtained each time before any of the funds may be expended: an employee or official of the school district designated by the governing board, the certificated employee who is the designated advisor of the particular student body organization, and a representative of the particular student body organization."

So, since the teachers are not getting the expenditures in question pre-approved by the appropriate individuals (student representative, ASB advisor and the principal/board designee), ASB funds should not be used to reimburse the teachers as that would be against the Education Code.
