Under what circumstances would a water only vending machine be permissible?

Question: Would a water only vending machine in the cafeteria available for students to purchase be in violation of the 4 times per year food sale rule? Our cafeteria does not sell water. If this is not allowable, under what circumstances would a water only vending machine be permissible?

Response: Water sold by students could only occur four times per year, as water is included in the food laws. An alternative would be for the cafeteria program to run the water only vending machine, which could be sold daily as the four times per year rule does not apply to cafeteria programs. Perhaps the cafeteria program would be willing to share part of the profits with the ASB organization, which would be permissible.
