Question: What is the penalty for a teacher holding a raffle at a scheduled event?

Response: It is a misdemeanor violation of penal code to hold a raffle without officially registering with the Department of Justice, which can only be done by private non-profit groups. The web site to register is www.caag.state.ca.us. Because a teacher is not a private non-profit entity (nor, in fact, is ASB), they cannot register to hold a raffle. This means the teacher could be fined, and could end up with a misdemeanor offense on their record. In addition, because the teacher is probably not reporting the proceeds as income and is probably not raising funds through a non-profit organization, it could be considered tax fraud by the IRS.
