SARB MEMBERSHIP
Effective January 1, 2001, Chapter 222 of the statutes of 2000 (AB 42) amends Education Code Section 48321(a) so as to require county SARBs to include "a representative of school or county health care personnel." Chapter 222 also amends Section 48321(b) so as to allow for, but not require, "a representative of school or county health care personnel" to serve on local school district SARBs.
School nurses may be designated to serve in this capacity.
PARENT MEMBERSHIP ON SARB
Until January 1, 2001, "a parent" must be included as a member of a county-wide or district SARB. On or after January 1, 2001 county-wide or district SARBs may but are not required to include a parent as a member.
Please Note: The parent who may serve as a member of SARB is not the parent who is subject to the jurisdiction of SARB.
DISCLOSURE OF PUPIL INFORMATION
Effective January 1, 2001, Chapter 222 amends Education Code section 49076(a) so as to require school districts to disclose "particular [student] records relevant to the legitimate educational interests of … any judge or probation officer for the purpose of conducting a truancy mediation program for a pupil, or for purposes of presenting evidence in a truancy petition pursuant to Section 681 of the Welfare and Institutions Code."
Before releasing information for these purposes the district must adhere to the following requirements:
The judge or probation officer shall certify in writing to the school district that the information will be used only for truancy purposes. A school district releasing pupil information to a judge or probation officer pursuant to this paragraph shall inform, or provide written notification to, the parent or guardian of the pupil within 24 hours of the release of the information.
