Who approves transferring ASB funds from a senior class to an incoming freshman class?

Question: The Senior Class of 2009 submitted club minutes that they wanted to transfer their remaining Class of 2009 funds ($6,737.48)to the Class of 2013. The advisors of 2009 will be the same advisors for 2013. There were only 20 signatures of the class of 2009 who signed the sign-in sheet attending the Class 2009 meeting who agreed. The class of 2009 has 480 senior members. Somehow this does not sound right to me. What do you suggest or advise?

Response: First, we are glad to see that the senior class actually made a decision about the remaining funds in their account prior to graduation.  This is a good practice, rather than graduating and just leaving funds without any direction.  The advisor is to be commended for ensuring this occurred.

Education Code section 48933 requires that ASB funds must be spent with the preapproval of three people: an employee or official of the school district designated by the governing board (which is usually the principal), the ASB advisor (must be a certificated employee), and a student representative of the ASB organization.  So, this transfer at a minimum would have to be approved by a student representative, the ASB advisor and the principal (assuming that is who the Board had designated). As to how many students voted on the transfer, only the club’s past practice and constitution can tell you whether or not the 20 signatures is enough for a decision to be made.  At a minimum, Education Code must be followed.  As to how many additional signatures are needed depends on local policy and practice.
